Hello. I'm working on having a new application to the City of Nelson for a use permit that will let us open. The time line is defined by money. I feel that having a legally supported application submitted for consideration in August is achievable. For now the space is available for events or other ideas. Happy HIgh!

Hi Everyone. I am happy to provide an update on where Yaherb is at. I will be reapplying for the permit from the City of Nelson that will allow for Yaherb to open as a Cannabis friendly Cafe with cannabis consumption permitted on the balcony. The property was for sale. There have been no offers. Over the past seven years I have put a lot of energy and money into helping see cannabis comsumption spaces permitted and for my cafe to benefit from this. My first application was denied in May by the City. I am re applying in the next couple of weeks. I need to generate income(a business not open still costs money) and keep my business viable so I am staying in the commercial building I own. This application is being support with legal help from Vancouver Island based lawyer Robert Laurie. I will keep you posted. Thanks.

Hello Everyone I hope you are enjoying this Beautiful day. As you might have heard the city of nelson denied our permit to open a cafe that has a cannabis friendly patio. We will be retaining the legal and advice services of Jack Lloyd and Kirk Tousaw. A go fund me will be shared in the next couple of days with the goal of raising the $5600 retainer. The goal is to review the process so far and to assert ourselves more firmly when we reapply with a new application. This is a process that will benefit anyone interested in cannabis consumption spaces in British Columbia. More to follow soon!!

Here Is an update on the process Yaherb Cafe is undertaking to be able to legally open and operate in 2025. The City of Nelson Zoning Bylaw does not permit cannabis consumption cafes, sharing, advertising and more. Yaherb had engaged in a process for several months with the city around how to best move forward. The city indicated that a zoning bylaw amendment might happen in December. This did not happen. On follow up it was apparent that no progress had been made using this approach. Yaherb is now submitting a formal zoning variance request for our location in order to open. This process ensures we are in the departments work flow and there is a clear process towards a decision. The fee for this is variance application is $3000 plus some other associated legal fees. I feel confident that the zoning request is reasonable and will be successful. Further updates to follow. Happy New Year!

Working hard on finding a legal way to open and operate a cafe that has a cannabis friendly outdoor hospitality patio. Provincial regulations are now permissive. It is City of Nelson cannabis bylaws that we now have to navigate. Was hoping to be open by now, but the legal risks are too big. We are working hard and anticipate being one of the first cannabis culture cafes in Canada. Have a Beautiful harvest season.
