“ Almost every significant piece of federal legislation contains unrelated add-ons that are included to ensure that bill supporters obtain their necessary number of votes. The recently passed spending bill, which ended the government shutdown, is no exception and this time around, a new tucked away measure could spell disaster for the affiliated CBD marketplace and is already causing disruptions across our industry.
H**p, which is a derivative of the cannabis plant, was legalized in the 2018 Federal Farm Bill and intended to be used for purposes such as rope and textiles. However, the law's broad definition created a loophole on THC, the psychoactive compound that has fueled the rapid expansion of cannabidiol (CBD) products such as gummies, drinks, and vapes.
However, the new legislation creates a federal ban on any product containing more than 0.4 milligrams of THC per container. According to industry executives quoted in a recent Wall Street Journal article, that threshold would wipe out nearly 95% of the $28B retail h**p market. Jonathan Miller, the General Counsel for the U.S. H**p Council recently stated that "We have lost the battle this time. In effect, this is an all out, complete ban on h**p products in the United States."
The h**p restrictions go into effect in November of 2026 and the new statute requires that the FDA create guidance and official compliance rules by February 10th. Much will be officially decided over the coming months but sponsor banks across our industry, many of which were already leery of CBD products, are re-evaluating their approach. While we have not yet heard of any official changes from the sponsor banks we work with, I've heard from multiple other ISOs about forced closures of CBD related MIDs with little advance notice. As we all know, sponsor banks tend to be risk averse and have no interest in pushing the envelope or playing in the gray space of federal regulations.…”
