HAPPY NEW YEAR!

We just got back from vacation so we apologize for not posting an update in a while. As you recall from our last update (below) we had agreed to enter into mediation with Weyland Ventures, Bill Weyland, and Lee Weyland (whom we have sued for fraud etc.,) and all parties had agreed on the choice of a mediator as well as the date for the mediation -- January 11th -- with what we, at ChurchKey at least, had hoped was going to be a joint effort at arriving at a resolution.

Leading up to the agreement to mediation we had repeatedly extended to them and their attorney at the Tad Adams Law Firm the courtesy of extending the deadline for their answer to our lawsuit -- an answer mandated by Kentucky law and with a filing deadline that they are required to comply with unless granted an extension by the court or agreed to by us.

When it became clear to them after being granted numerous extensions that they would be required to file their answer to our suit BEFORE the mediation (and thus spend money on legal fees which they had avoided due to their delays) they canceled the mediation claiming that being required to answer our lawsuit before mediation would somehow be unfair to them. Which, of course, is patently, laughably ridiculous and, to us (and to anyone with a working brain), would seem to clearly indicate that they and their attorney are nothing more than bad faith negotiators and that their agreement to mediation was, more than likely, simply a cheap lawyers delaying trick designed to cost us money in legal fees and to frustrate and stymie the legal process.

So, to paraphrase Sonny and Cher -- and the lawsuit goes on!

Stay tuned for their answer to our lawsuit due sometime this week or next (and likely counterclaims from them filed against us because.... of course they will!) and then.......

DISCOVERY! Which will entail subpoenas for their tax records going back years, banking records going back years, records of payments going back years, lease agreements, and literally years of phone records, email communications, text messages from their phone companies, as well as depositions, interrogatories, a ton of documents and IRS filings, subpoenas of past and present contractors and their records, consultants and their records, and employees of Weyland Ventures past and present etc., etc., etc., etc.

And we'll be back with further updates as well as the promised link to our lawsuit so you can read our complaint in its entirety for yourselves.

LAWSUIT UPDATE

We've been asked by our attorneys to refrain, for the time being, from further posting of any comprehensive (and amusing....to us at least) updates on the lawsuit against our landlord Weyland Ventures/Kirche and Bill and Lee Weyland. Stress: for the time being.

Our lawyers at Ackerson and Yann PLLC (superb attorneys btw, should you ever need their services) feel that even though everything we've said publicly on the subject is not just demonstably true but also falls clearly under protected speech under the Constitution of the United States; we're at a point where both sides have agreed to enter into mediation with the hopes of settling the matter satisfactorily, and our informative (and entertaining) social media updates could negatively impact negotiations.

We believe in listening to the advice of our excellent team of attorneys and will refrain.....for the time being.....from posting further updates in the hope that a genuine, good faith negotiation by both parties will result in a good outcome. A hope by us for a good outcome, frankly, for all concerned.

So, for now its radio silence.

This is Funny!

Not ha ha funny, but more like kind of pathetic funny.

So we sent our lawsuit complaint off to the landlord and they refused to accept service of the lawsuit when it got to their offices via hand delivery. We're picturing all those named in the fraud lawsuit at Weyland Ventures hiding in the office supply closet, sticking their tongues out and saying nya nya nya nya nya as they all hide so as to avoid accepting and signing for the complaint when the delivery came in. (OK, so that's kind of a ha ha funny mental image amirite?)

Aaaaanyways......their lawyer, The Vaunted Tad Adams Law Group™, has filed a dismissal request with the court based upon lack of jurisdiction. In support of their claim of lack of jurisdiction The Vaunted Tad Adams Law Group™ has asserted that because the green card acknowledging receipt of service of the complaint was not signed and returned (because the recipients may or may not have been hiding in the company supply closet in order to avoid being served) therefore the case should be dismissed due to defective service.

To simplify things a bit, here's a quick example: the process server comes to your door to serve you with papers, you hide in a closet in order to avoid service and he leaves the papers at your door or with your secretary as a courtesy to you because everybody already knows you're getting served because the folks suing you told you so as a courtesy to you and your lawyer at The Vaunted Tad Adams Law Group™! And then you claim that service was bad because you were hiding in your supply closet and didn't sign the green card acknowledging receipt and therefore the whole case should be dismissed.....because you were hiding in a closet. Got it?

And the net result of all this? Other than wasting the Court's precious time?

We simply re-serve the complaint.

At their homes and offices.

But this time using sheriff's deputies.

I don't know about you but if our lawyers suggested to us that hiding in a supply closet in order to avoid service of a complaint was a legitimate tactic, we might begin to have some serious concerns about the direction of our legal strategy. Just saying.

So now, if you happen to find yourselves at the offices of Weyland Ventures, or at the homes of Bill Weyland or Lee Weyland, and the sheriff's come busting (well, strolling in or politely knocking), don't be surprised. It's Just ChurchKey being forced by the Vaunted Tad Adams Law Group™ and Weyland Ventures to be a bit less courteous than we had originally hoped.

Since we've had over 10,000 mostly local views and engagements from our Facebook post announcing the suit we've decided to launch a blog (which we'll link here) in the next week where anyone interested can read the lawsuit and follow along with the case as it proceeds as well as get updates on any additional shenanigans by our opponents and their lawyers at The Vaunted Tad Adams Law Group™.

And FYI, here's an update on CORE Realty Partners -- the realtors who are unlawfully marketing our property without our permission -- they've finally gotten their act together and corrected the address for ChurchKey that they had wrong on all their marketing materials. So good for them!

Unfortunately, they don't seem able to understand that their continued marketing of our property without our permission could/will definitely result in their clients becoming embroiled in a lawsuit. Hopefully they're divulging this information to any and all clients.

ChurchKey Update

Thanks to everyone who responded with overwhelming support regarding our announcement that we've been forced to sue our landlord Weyland Ventures, Kirche llc, Bill Weyland and Lee Weyland for fraud etc.

As you can see, our post announcing the lawsuit appeared on almost 7,000 pages with over 2,000 engagements/reactions by readers -- the vast majority of those almost 7,000 are local to the Louisville metro area and located within 25 miles of ChurchKey.

As we indicated previously; we will post a link in the coming days to the actual lawsuit so you can read for yourselves why we were forced to take this action.

We believe that once you've read the lawsuit you will all agree with our characterization of the actions and behavior of Weyland Ventures, Kirche, Bill Weyland, and Lee Weyland as being outrageous, wrongful, beyond the pale, and deserving of sanction.

UPDATE

Unfortunately, after months of trying to resolve the issues created solely by our landlord we have had to take the unfortunate step of filing suit against them.

The suit names our landlord Kirche LLC/Weyland Ventures along with both Bill and Lee Weyland personally; both of whom are principals of Kirche/Weyland Ventures.

Our allegations of fraud, unjust enrichment, breach of contract, breach of good faith and fair dealing, breach of fiduciary duty, etc., are all spelled out clearly and concisely in the complaint titled:

ICE STATION ZEBRA ASSOCIATES LLC v. KIRCHE LLC, WEYLAND VENTURES, C. WILLIAM WEYLAND, and LEE WEYLAND ET AL. and is now a matter of public record.

When it becomes available to do so we will post a link to the full complaint here so that those who are interested can review it.

Any and all press inquiries should be directed to the law firm of Ackerson & Yann PLLC.

Previously, we had politely asked the brokerage firm of Core Real Estate Partners here in Louisville to cease and desist with their unauthorized marketing of our property and their infringement and use of our brand name but they have, so far and as of this writing, refused our request. Apparently we'll now need to do more than just ask politely.

And I guess we may also need to assist them with their understanding of addresses here in Louisville, since the address listed in their unauthorized advert (below) -- 601 East Market St. -- BELONGS TO A TIRE STORE ACROSS THE STREET!

Pro tip to Core RE Partners:

Even numbers on avenues in Louisville are on the south side of the street. Odd numbers are on....the north side. Getting a listing address wrong is not a good look for a real estate company. Being a commercial real estate firm and not knowing which side of the street the numbers go is just plain sad...mmmmkay?

Some folks here in the 'Ville have noticed that there's a Core Real Estate Properties Company FOR RENT sign up at ChurchKey and reached out to us about it. Not to worry!

Since ChurchKey is so visible and on such a high traffic corner, that sign was put up at the request of Core and our landlord Weyland Ventures and with the permission of ChurchKey's owner months ago with the stated intention by Core and our landlord for the sign to draw attention to other properties our landlord had to offer in the area.

We try to help other businesses out whenever we can, especially during these very trying times for the retail and real estate businesses, and our owner felt that helping our landlord and Core Real Estate Properties Co. by giving them permission to use our high visibility corner as a rent-free billboard was the least we could do.

Since their signs are now causing confusion we’ve asked Core to remove them. Rest assured, ChurchKey may have been badly delayed due to our landlord's ongoing failure to complete its contractual obligations under our lease but we still aim to open for business just as soon as they finish the work the lease requires them to do.
