From Page Action Committee: We understand that the citizens have been engaged in a prolonged battle to preserve Lake Powell Boulevard. On April 4, 2024, the City served our committee, the Page Action Committee, a letter rejecting our petition signatures. They cited a section of the Arizona Constitution, which does not allow citizens to refer action taken by the city council that are not so-called โlegislative acts.โ Our initiative does not refer any act of the council and it is unknown why the City would offer this as a reason to reject over 800 signatures from Page voters.
Although it would have been easier to collect 200 signatures for a referendum, we valued the opportunity to engage with the amazing citizens of Page during this process. The Arizona Constitution and statutes are clear; citizens have the right to initiate a ballot measure to address various issues, including matters related to transportation and infrastructure. If citizens are concerned about preserving the number of lanes on a street, they can propose a ballot measure to address this issue.
Consequently, the committee has filed a case against the City of Page in the Coconino Superior Court, which is set for a hearing on April 18, 2024. The city's letter also mentioned that they did not provide a random sample. However, contrary to this, the City produced a document that purported to be the random sample.
Our complaint filed with the superior court includes our concerns regarding the errors in the random sample, improperly removed whole petition sheets, and the removal of the signature from a man who needed assistance due to his disability.
